GrowthClub5 makes no guarantees of specific outcomes. You assume all risks associated with using this service.
Acceptance of Terms
By accessing or using GrowthClub5 ("Company," "we," "us," or "our") services at growthclub5.com (the "Site"), creating an account, or purchasing any subscription or add-on, you ("Customer," "User," or "you") agree to be legally bound by these Terms of Service ("Terms") in their entirety.
If you do not agree with any part of these Terms, you must immediately cease using the Site and our services. Continued use of the Site constitutes your ongoing acceptance of these Terms.
These Terms constitute the entire agreement between you and GrowthClub5 regarding your use of the service and supersede any prior agreements or understandings.
Description of Service
GrowthClub5 provides social media growth services, including Instagram follower delivery, post engagement boosts (likes and comments), and related digital marketing services (collectively, the "Services").
Our Services are delivered via third-party social media growth providers. We act as an intermediary service that facilitates the delivery of social engagement metrics to your social media accounts. We do not own, operate, or control Instagram or any other third-party social media platform.
Service delivery is subject to:
- Availability and uptime of third-party delivery providers
- Instagram's platform policies, algorithms, and technical changes
- The quality and authenticity of your Instagram profile and content
- Network conditions and technical factors outside our control
Eligibility & Account Requirements
You must be at least 18 years of age to use GrowthClub5 services. By using our services, you represent and warrant that you are at least 18 years old.
You are solely responsible for:
- Providing accurate account information including your Instagram username
- Ensuring your Instagram account is set to public during service delivery
- Maintaining the security of your GrowthClub5 account credentials
- All activity that occurs under your account
Important: Your Instagram account must remain public during the delivery period. GrowthClub5 is not responsible for failed or incomplete deliveries resulting from a private account setting.
Service Disclaimer & No Guarantees
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.
GrowthClub5 expressly disclaims all warranties and makes no guarantees regarding:
- Follower retention: Followers delivered may decrease over time due to Instagram's periodic removal of inactive or low-quality accounts. We are not responsible for any drop in follower count after delivery.
- Delivery speed: While we aim to deliver within stated timeframes using drip-feed technology, actual delivery speed may vary and cannot be guaranteed.
- Exact quantities: Delivered quantities may vary by up to 10-15% from the stated amount due to natural attrition during the delivery process. This is normal and expected.
- Account growth outcomes: We make no guarantees that our services will result in increased revenue, brand awareness, business opportunities, or any other specific outcome.
- Service continuity: We reserve the right to modify, suspend, or discontinue any service at any time without prior notice.
- Engagement quality: We do not guarantee that delivered followers, likes, or comments will be from any specific demographic, location, or interest group.
Partial Delivery Acknowledgment: You expressly acknowledge and agree that receiving less than the full stated quantity of followers or engagement is a known and accepted risk of social media growth services. GrowthClub5 shall not be held liable for partial deliveries caused by platform algorithm changes, account restrictions, or third-party provider limitations.
Third-Party Platform Risk
You acknowledge and agree that the use of social media growth services may violate Instagram's Terms of Service and Community Guidelines. By purchasing our services, you accept full and sole responsibility for any consequences that may result from Instagram's enforcement actions, including but not limited to:
- Account warnings, restrictions, or reduced reach
- Temporary or permanent account suspension
- Removal of followers, likes, or comments by Instagram
- Shadowbanning or reduced visibility in search and explore
- Loss of monetization features or partnership eligibility
- Any financial losses resulting from account restrictions
CRITICAL DISCLAIMER: GrowthClub5 is NOT responsible for any action taken by Instagram or any other social media platform against your account, including permanent account termination. You assume ALL risks associated with using third-party growth services on your account. Any financial losses, business losses, or reputational damage resulting from platform enforcement actions are solely your responsibility.
GrowthClub5 will not provide refunds for services already delivered or in progress when Instagram takes action against your account.
You expressly agree that your decision to use GrowthClub5's services is made knowingly, voluntarily, and at your own election, in the same manner as any individual's voluntary decision to use a legal product or service that carries inherent risk to the user. GrowthClub5 makes no representation that its services are risk-free, and you agree that you are not relying on any such representation in choosing to purchase or continue using the services.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL GROWTHCLUB5, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, PARTNERS, OR SUPPLIERS BE LIABLE FOR ANY:
- Indirect, incidental, special, consequential, or punitive damages
- Loss of profits, revenue, data, business, or goodwill
- Business interruption or loss of business opportunities
- Personal or reputational harm
- Cost of substitute services
- Any damages arising from Instagram or third-party platform actions
REGARDLESS OF WHETHER GROWTHCLUB5 HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, AND REGARDLESS OF THE THEORY OF LIABILITY (CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE).
IN ALL CASES, GROWTHCLUB5'S MAXIMUM AGGREGATE LIABILITY TO YOU FOR ANY CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE TOTAL AMOUNT YOU PAID TO GROWTHCLUB5 IN THE 30 DAYS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
Plain Language Summary: If something goes wrong — including your account being banned, followers not delivering fully, or any financial loss — the most GrowthClub5 can ever be required to pay you is the amount you paid us in the last 30 days. We are never responsible for lost income, lost business, or account bans.
Refund Policy
Due to the nature of digital services, all sales are generally final. However, we offer the following limited refund policy:
- Subscription refunds: You may cancel your subscription at any time. Cancellations take effect at the end of the current billing period. No partial-month refunds are issued.
- Non-delivery: If zero followers are delivered within 7 days of a successful payment and there is no technical issue with your account (e.g., private account), you may request a service credit.
- No refunds for: Partial deliveries, follower drop-off after delivery, account restrictions or bans, change of mind, or dissatisfaction with follower quality.
- Add-on purchases: All boost purchases (likes, comments) are non-refundable once delivery has begun.
All refund requests must be submitted to support within 7 days of the relevant billing date. GrowthClub5 reserves the right to issue service credits in lieu of monetary refunds at our sole discretion.
Payments & Billing
All payments are processed securely through Stripe. By providing payment information, you authorize GrowthClub5 to charge your payment method on a recurring monthly basis until you cancel.
- Subscriptions renew automatically on the same date each month
- You will receive an email notification before each renewal
- It is your responsibility to cancel before the renewal date if you do not wish to be charged
- Failed payments may result in service suspension
- All prices are in US Dollars (USD)
- GrowthClub5 reserves the right to change pricing with 30 days notice
Prohibited Uses
You agree not to use GrowthClub5 services for any account that promotes or contains:
- Hate speech, discrimination, or content targeting individuals based on race, religion, gender, or sexual orientation
- Violence, terrorism, or content that incites harm
- Illegal activities, scams, or fraudulent content
- Adult content involving minors
- Spam, phishing, or misleading commercial practices
GrowthClub5 reserves the right to terminate any account and forfeit all payments without refund if we determine, at our sole discretion, that your account violates these prohibited use policies.
Termination
GrowthClub5 reserves the right to suspend or terminate your account and access to services at any time, with or without cause, with or without notice. Reasons for termination may include but are not limited to:
- Violation of these Terms of Service
- Fraudulent or chargebacks activity
- Abusive behavior toward our team
- Use of prohibited content as described above
Upon termination, your right to use the services immediately ceases. No refunds will be issued for remaining subscription time upon termination for cause.
Indemnification
You agree to indemnify, defend, and hold harmless GrowthClub5 and its officers, directors, employees, agents, and partners from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorney's fees) arising from:
- Your use of and access to the services
- Your violation of any term of these Terms of Service
- Your violation of any third-party right, including Instagram's Terms of Service
- Any claim that your use of the services caused damage to a third party
- Any action taken by Instagram or other platforms against your account
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Arkansas, United States, without regard to its conflict of law provisions.
Any disputes arising under these Terms shall be resolved through binding arbitration in accordance with the American Arbitration Association's rules, rather than in court, except that either party may seek injunctive relief in court for violations of intellectual property rights.
YOU WAIVE YOUR RIGHT TO A JURY TRIAL AND YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION.
Severability
If any provision of these Terms is found by a court or arbitrator of competent jurisdiction to be invalid, illegal, or unenforceable, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining provisions of these Terms shall remain in full force and effect. The invalidity of any one provision shall not affect the enforceability of the remainder of these Terms.
Changes to Terms
GrowthClub5 reserves the right to modify these Terms at any time. We will notify users of material changes by updating the "Last updated" date at the top of this page and, where appropriate, by sending an email notification.
Your continued use of the services after any changes constitutes your acceptance of the new Terms. If you do not agree to the modified Terms, you must stop using the services and cancel your subscription.
